1. Introduction and Acceptance of Terms

Welcome to Fix My Ride ("the App"). The App is developed, owned, and operated by Akshat Srivastava ("the Developer," "I," "Me," or "We").

By downloading, installing, accessing, or using Fix My Ride, you ("the User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately uninstall and discontinue the use of the App.

WARNING: THIS APP IS INTENDED FOR INFORMATIONAL PURPOSES ONLY. BY USING THIS APP, YOU ACKNOWLEDGE THAT THE DEVELOPER BEARS NO RESPONSIBILITY FOR YOUR SAFETY, VEHICLE, OR LIFE.

2. Description of Service

Fix My Ride provides an aggregation of emergency contact numbers, Roadside Assistance (RSA) details for various car brands, and educational content such as "Know Your Dashboard" and "Car Bytes".

While the App aims to assist during emergencies, it is software, subject to bugs, crashes, and data inaccuracies. It is not a replacement for official emergency services or professional mechanical advice.

3. Disclaimer of Warranties ("As Is" Clause)

To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.

The Developer expressly disclaims all warranties, including but not limited to:

  • • Functionality: That the App will function without interruption, delay, or error.
  • • Accuracy: That the RSA numbers, helpline numbers (e.g., 112, 100, 1033), or educational content are accurate, active, or correct.
  • • Compatibility: That the App will work with your specific device, operating system (iOS/CarPlay), or network provider.

4. Limitation of Liability (The "Zero Liability" Clause)

PLEASE READ THIS SECTION CAREFULLY.

Under no circumstances, including but not limited to negligence, shall the Developer be liable for any direct, indirect, incidental, special, punitive, or consequential damages that result from the use of, or the inability to use, this App.

Specific Exclusions of Liability: You explicitly acknowledge and agree that the Developer is NOT RESPONSIBLE for:

  • • Loss of Life or Physical Injury: Any bodily injury, death, or health complications resulting from delayed emergency response, app failure, or reliance on the App's content.
  • • Vehicle Damage: Any damage to your vehicle resulting from following advice in "Car Bytes" or "Know Your Dashboard."
  • • Software Failure: Any damages occurring because the App crashed, failed to load, failed to cache data offline, or failed to launch via CarPlay.
  • • Network Issues: Failure of the App to dial numbers due to network coverage, carrier restrictions, or device settings.
  • • Trivial to Catastrophic Loss: Any loss ranging from minor inconveniences (e.g., wasted time, "death of a mosquito") to catastrophic events (e.g., total vehicle loss, fatality).

5. Accuracy of Information & User Responsibility

The App acts solely as a directory.

  • • Verification: You acknowledge that telephone numbers (RSA, Helplines) change frequently. It is your sole responsibility to verify the accuracy of any number before or during an emergency.
  • • Call Failure: The Developer is not responsible if a number listed in the App is disconnected, wrong, busy, or fails to connect.
  • • Educational Content: Information provided in "Know Your Dashboard" and "Car Bytes" is for general reference only. The Developer is not a certified mechanic. Always consult your vehicle's manual or a professional.

6. Intellectual Property & Third-Party Trademarks

6.1. Brand Names and Logos

The App displays logos and names of various automobile manufacturers (e.g., Toyota, Hyundai, Tata, etc.) solely for the purpose of identifying Roadside Assistance contacts.

  • • Ownership: All third-party trademarks, logos, and brand names are the property of their respective owners.
  • • No Affiliation: The use of these trademarks does not imply any affiliation with, endorsement by, or partnership with these brands. Fix My Ride is an independent project by a solo developer.
  • • Display Errors: The Developer is not liable for any graphical errors, including but not limited to brand logos being cropped, distorted, colored incorrectly, or displayed out of frame due to UI rendering issues on different devices.

6.2. Copyright Claims

If you are a copyright owner and believe your intellectual property is being used improperly, or if a brand logo is displayed in a manner you object to, please contact me immediately for removal or correction:

7. Advertising & Sponsorship Disclaimer

  • • Google AdMob: This App uses Google AdMob to serve advertisements. The Developer has no control over the specific content of ads shown to you.
  • • Coincidence of Content: If an ad displays a car brand or product related to your vehicle or the App's content, this is purely coincidental or based on ad algorithms. It does not imply a partnership or specific endorsement between the Developer and the advertiser.
  • • No Liability for Ads: The Developer is not responsible for any loss or damage incurred as a result of your interaction with third-party advertisements.

8. Third-Party Assets and Graphical Content

  • • Flaticon: Various icons and assets used in the App have been sourced from Flaticon.com. Copyrights for these assets remain with their respective designers/owners.
  • • Content Appropriateness: The App may contain graphical content (including images in "Car Bytes") that may be sourced from free repositories or generated via Artificial Intelligence. The Developer is not responsible if users find specific imagery inappropriate, inaccurate, or visually unappealing.

9. Data Privacy and Security

  • • Firebase: The App uses Google Firebase (Auth, Firestore, Storage) for backend services.
  • • Data Loss: The Developer is not responsible for any loss of user data (e.g., saved Emergency Contacts, Profile Images) due to server outages, hacking, or account deletion.
  • • Data Breach: While we utilize secure methods (Firebase Auth), the Developer is not liable for any data breaches, leaks, or unauthorized access to your account or personal information.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically within the jurisdiction of Uttar Pradesh, without regard to its conflict of law provisions.
